WESLEY CHAPEL — One of the developers of the proposed Cypress Creek Town Center plans to appeal a judge's ruling last week throwing out most of the wetlands permit for the project.
Sierra Properties filed an appeal notice and paid the $455 fee Friday, according to documents in U.S. District Court.
"We'll wait to see what the government does," said Denise Layne, spokeswoman for the Sierra Club, which challenged the permit several years ago with its lawsuit against the U.S. Army Corps of Engineers.
The Sierra Club has argued that the corps failed to ensure the protection of the nearby Cypress Creek, a protected waterway that feeds into Hillsborough County's drinking water supply. In a harshly worded ruling earlier this summer, U.S. District Judge Royce C. Lamberth agreed, and last week he vacated most of the permit for the 1 million-square-foot regional mall.
