TAMPA — A a jogger who shot and killed one of two teenagers who confronted him in Town 'N Country will not be charged, the Hillsborough State Attorney's Office announced Tuesday.
Thomas Baker, 28, was jogging near his home about 1 a.m. on Nov. 24 when a 16-year-old and an 18-year-old approached him. Baker told deputies he thought they were going to rob and hurt him. He pulled out a .45-caliber semiautomatic handgun and shot Carlos Musteliel, 18, several times. Musteliel died.
Authorities did not find a weapon on either teenager. No one involved had a criminal record, deputies said.
Officials did not explain why charges won't be filed. Instead, prosecutors released a statement through the Hillsborough County Sheriff's Office:
